Terms of Service
BreatheFlow ("the app", "we", "us") is a guided breathing companion published by EK Cyber and Media. By using the app you agree to these terms. If you don't agree, please don't use the app.
Not medical advice. BreatheFlow is a wellbeing and mindfulness tool. It is not a medical device, not a substitute for professional medical care, and nothing in the app diagnoses, treats, or cures any condition. If you have any health concern — including but not limited to respiratory, cardiac, neurological, or psychiatric conditions — talk to a qualified clinician before practicing breathwork.
What BreatheFlow is
A free progressive web app and (planned) mobile app that guides breathing patterns, plays voice cues, tracks BOLT scores, and stores your sessions locally or synced to your account. Features may be added, changed, or removed at any time without notice.
Eligibility
You must be at least 13 years old to create an account. Children under 13 may use the app only under direct supervision of a parent or guardian, who is fully responsible for any data created in that context.
Your account
If you sign in, you are responsible for keeping your Google account secure. Tell us promptly if you suspect unauthorised access by emailing support@breatheflow.app. You can delete your account and all synced data at any time via Settings → Delete account.
Acceptable use
Don't use the app to (a) violate any law; (b) attempt to reverse-engineer, exploit, or attack the service or other users; (c) submit content (e.g. via "Send feedback") that is illegal, abusive, deceptive, or infringes anyone's rights; (d) use the app in a way that could create a safety risk for yourself or others — for example, practising apnea-style holds while driving, swimming, or operating machinery.
Health and safety
Breathing practices, especially extended exhalations and breath retentions, can cause lightheadedness or fainting. Practise seated or lying down in a safe place. Stop immediately if you feel unwell. Pregnant users, anyone with cardiovascular or respiratory conditions, and anyone with a history of seizures should consult a clinician before using the app.
Intellectual property
The app, its source code, design, copy, audio assets, and the BreatheFlow name and logo are owned by EK Cyber and Media. You get a personal, non-transferable, non-exclusive licence to use the app for personal, non-commercial purposes. You don't get rights to redistribute, modify, or reverse-engineer the app, except as permitted by law (e.g. the limited rights under your local consumer-protection law that can't be waived).
User-submitted content
If you send feedback, you grant us a non-exclusive licence to read, store, and act on that message in order to operate and improve the app. We treat your feedback as confidential to the maintainer; we don't publish it.
Disclaimer of warranties
The app is provided "as is" and "as available", without warranties of any kind, whether express or implied, including but not limited to merchantability, fitness for a particular purpose, accuracy, reliability, or non-infringement. We don't guarantee uninterrupted service, error-free operation, or that the app will meet your specific needs.
Limitation of liability
To the maximum extent permitted by law, EK Cyber and Media will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the app, including but not limited to loss of data, loss of profits, or personal injury. Our total liability for any claim related to the app will not exceed CAD $50 or the amount you paid for the app in the prior 12 months — whichever is greater. Some jurisdictions don't allow these limitations; in those places they apply only to the extent permitted.
Termination
We can suspend or terminate your access to the app at any time, with or without notice, if you breach these terms or if we discontinue the service. You can stop using the app and delete your account at any time. The sections of these terms that should survive termination (intellectual property, disclaimers, liability, governing law) survive termination.
Changes to these terms
We may update these terms from time to time. Material changes will be reflected on this page with a new "Last updated" date. Continued use of the app after a change means you accept the updated terms.
Governing law
These terms are governed by the laws of the Province of Ontario, Canada, without regard to conflict-of-laws principles. Any dispute that can't be resolved informally will be brought in the courts of Ontario, except where mandatory consumer-protection law in your country gives you the right to bring a claim locally.
